Information on the collection of personal data

In the following we inform about the collection of personal data when using our website. Personal data are all data that can be related to you personally, e.g. name, address, e-mail addresses, user behavior.

When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, your name and telephone number if applicable) will be stored by us in order to answer your questions. We delete the data arising in this connection after storage is no longer necessary or restrict processing if there are legal storage obligations.


If we use contracted service providers for individual functions of our offer or wish to use your data for advertising purposes, we will inform you in detail about the respective processes below. We will also state the specified criteria for the storage period.

          Collection of personal data when visiting our website

            If you use the website for informational purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser sends to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website and to ensure its stability and security (legal basis is Art. 6 Para. 1 S. 1 lit. f DS-GVO):

              - Date and time of the request

              - Time zone difference to Greenwich Mean Time (GMT)

              - Content of the request (concrete page)

              - Access Status/HTTP Status Code

              - Amount of data transferred in each case

              - Website from which the request comes

              In addition to the data mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive in accordance with the browser you are using and through which certain information is transmitted to the site that sets the cookie (in this case, by us). Cookies cannot execute programs or transfer viruses to your computer. They are used to make the Internet offer as a whole more user-friendly and effective.


              Use of cookies:


              a) This website uses the following types of cookies, the scope and function of which are explained below:

                - Transient cookies (add b)

                - Persistent cookies (see c).

                b) Transient cookies are automatically deleted when you close the browser. This includes in particular the session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the shared session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.
                c) Persistent cookies are automatically deleted after a specified period of time, which may vary depending on the cookie. You can delete the cookies in the security settings of your browser at any time.
                d) You can configure your browser settings to your liking and, for example, refuse to accept third-party cookies or all cookies. Please note that you may not be able to use all the features of this website.
                e) The Flash cookies used are not registered by your browser, but by your Flash plug-in. Furthermore we use HTML5 storage objects, which are stored on your end device. These objects store the required data regardless of the browser you use and do not have an automatic expiration date.                   Use of our webshop

                    If you would like to order in our webshop, it is necessary for the conclusion of the contract that you provide your personal data, which we need to process your order. Mandatory data necessary for the processing of the contracts are marked separately, further data are voluntary. We process the data provided by you to process your order. For this purpose we can pass on your payment data to our house bank. Legal basis for this is art. 6 para. 1 p. 1 lit. b DS-GVO.

                      We may also process the data you provide in order to inform you about other interesting products from our portfolio or to send you e-mails with technical information.

                      We are obliged by commercial and tax law to store your address, payment and order data for a period of ten years. However, after [two years] we will restrict processing, i.e. your data will only be used to comply with legal obligations.


                      To prevent unauthorized access to your personal data by third parties, especially financial data, the ordering process is encrypted using TLS technology.

                         

                        Newsletter

                        With your consent, you can subscribe to our newsletter, with which we inform you about our current interesting offers. The advertised goods and services are named in the declaration of consent.


                        For the registration to our newsletter we use the so-called double-opt-in procedure. This means that after your registration we will send you an e-mail to the specified e-mail address in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 6 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP address and the time of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data.


                        Your e-mail address is the only mandatory information for sending the newsletter. The provision of further, separately marked data is voluntary and is used to address you personally. After your confirmation we will save your e-mail address for the purpose of sending the newsletter. The legal basis is Art. 6 para. 1 p. 1 lit. a DS-GVO.


                        You can revoke your consent to receive the newsletter at any time and unsubscribe. You can revoke your consent by clicking on the link provided in each newsletter e-mail, by sending an e-mail to info @ herbiepillows.com or by sending a message to the contact data provided in the imprint.


                        We would like to point out that we evaluate your user behavior when sending the newsletter. For this evaluation, the e-mails sent may contain so-called web beacons or tracking pixels, which are one-pixel image files stored on our website. For the analysis we link the data mentioned in § 3 and the web beacons with your e-mail address and an individual ID. You can object to this tracking at any time by clicking on the separate link provided in each e-mail or by informing us via another contact channel. The information is stored as long as you have subscribed to the newsletter. After you unsubscribe, we store the data purely statistically and anonymously.

                            This website uses Google Analytics with the extension "_anonymizeIp()". This allows IP addresses to be processed in a shortened form, thus excluding the possibility of personal references. If the data collected about you contains a personal reference, this is immediately excluded and the personal data is immediately deleted.

We can use the statistics obtained to improve our offer and make it more interesting for you as a user.                                         Our website uses Web Fonts from Google. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. For this purpose, we use ad server cookies, through which certain parameters can be measured to measure success, such as the display of ads or clicks by users. If you reach our website via a Google ad, Google Adwords will store a cookie on your PC. These cookies usually expire after 30 days and are not intended to identify you personally.                                             Besides Adwords Conversion we use the application Google Remarketing. This is a procedure with which we would like to address you again. This application allows us to show you our advertisements after your visit to our website during your further internet use. This is done by means of cookies stored in your browser, which are used by Google to record and evaluate your usage behavior when you visit various websites. In this way Google can determine your previous visit to our website. A combination of the data collected in the course of remarketing with your personal data, which may be stored by Google, does not take place by Google according to its own statements.                                             This website still uses the online marketing tool DoubleClick by Google.                                                 Facebook pixel

                                                Furthermore we use the analysis tool "Facebook-Pixel" of the social network Facebook. Facebook Pixel is operated by Facebook Inc, 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are located in the EU, Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, dublin 2, Ireland ("Facebook").

                                                Facebook pixels help us measure the effectiveness of our advertising and analyze the actions that users take on our site. Facebook pixels enable us to identify you as a visitor to our online offering as a target group for the display of ads (so-called "Facebook ads").


                                                We use Facebook pixels in order to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our website or who exhibit certain characteristics (such as interest in certain topics or products) that we transmit to Facebook (so-called "custom audiences").                                                 Payment service provider

                                                 

                                                  We use external payment service providers such as Paypal, Sofortüberweisung, Google Pay and Apple Pay to process credit card payments, through whose platforms payment transactions are processed. The following data are among the data processed by the payment service providers: Inventory data, such as name and address, bank data, such as account or credit card numbers, passwords, TANs and checksums, as well as contract, sum and recipient related data. Depending on the service provider, this information is absolutely necessary to successfully complete the transactions.

                                                  The data you enter will only be processed and stored by the external payment service providers we have named. We receive neither account-related nor credit card-related information. We only receive either confirmation of payment or negative information. Under certain circumstances, the data may be transferred to credit agencies by the payment service providers we have designated. The purpose of this transmission is to check identity and creditworthiness. The payment transactions are subject to the data protection information and the data protection notices of the respective payment service providers, which can be accessed within the respective websites or transaction applications. The legitimate interest here is that the payment providers have a legitimate interest in understanding whether and how often the website is used to ensure and improve the functionality of their services.                                                     This website is hosted by an external service provider. The personal data collected on this website is stored on the hoster's servers. This may include, but is not limited to, IP addresses, contact requests, meta and communication data, contract data, contact details, names, website accesses and other data generated by a website. The use of the hoster is for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 para. 1 lit. f DSGVO). Our hoster will only process your data to the extent necessary to fulfill its performance obligations and will follow our instructions with regard to this data. We use the following hoster:

                                                      We currently use the following social media plug-ins: Facebook, Instagram and Pinterest. We use the so-called two-click solution. This means that when you visit our website, no personal data is initially passed on to the providers of the plug-ins. You can recognize the provider of the Plug-In by the mark on the box above its initial letter or logo. The buttons give you the opportunity to communicate directly with the plug-in provider. If you click on the marked box and thereby activate it, the plug-in provider will receive the information that you have accessed the corresponding website of our online offer. In addition, the data mentioned under II. will be transmitted.

                                                       

                                                      In the case of Facebook, according to the provider in Germany, the IP address is anonymized immediately after it is collected. By activating the Plug-In, your personal data is transmitted to the respective Plug-In provider and stored there (with US American providers in the USA). Since the plug-in provider collects the data in particular via cookies, we recommend that you delete all cookies before clicking on the grayed-out box via the security settings of your browser.

                                                       

                                                      We have no influence on the collected data and data processing procedures, nor are we aware of the full scope of data processing, the purposes of data processing, the storage periods. We also have no information about the deletion of the collected data by the plug-in provider.

                                                       

                                                      The plug-in provider stores the data collected about you as user profiles and uses them for the purposes of advertising, market research and/or demand-oriented design of its website. Such an evaluation is carried out in particular (also for users who are not logged in) for the purpose of presenting need-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact the respective plug-in provider to exercise this right. Through the plug-ins we offer the possibility to interact with the social networks and other users, so that we can improve our offer and make it more interesting for you as a user.

The data will be passed on regardless of whether you have an account with the plug-in provider and are logged in there. If you are logged in with the plug-in vendor, your data collected by us will be directly assigned to your existing account with the plug-in vendor. If you click on the activated button and, for example, link the page, the Plug-In Provider will also save this information in your account and share it publicly with your contacts. We recommend that you log out regularly after using a social network, but especially before activating the button, as this can prevent the Plug-In Provider from assigning it to your profile.
